MODTIME — TERMS OF SERVICE

 

1. General Information

This website is operated by ModTime – Franciszek Gliwiński, located at:
ul. Cumowników 5
81-517 Gdynia
Poland

These Terms of Service govern your use of our website and your purchase of products from ModTime. By using our website or placing an order, you agree to these Terms.

 

2. Our Products

Each ModTime watch is hand-assembled and individually tested before shipment.

Due to the nature of custom assembly:

  • small variations in appearance may occur,

  • processing times may vary (4–6 days),

  • delivery times depend on international shipping conditions.

We make every effort to ensure accuracy in descriptions, photos, and specifications, but slight variations may occur due to handcrafted assembly.

 

3. Order Processing

Once an order is placed:

  • you will receive an order confirmation via email,

  • assembly and quality testing begin within 24–48 hours,

  • shipping occurs immediately after testing is completed.

We reserve the right to cancel or refuse an order if:

  • the payment was not successfully processed,

  • fraudulent activity is suspected,

  • shipping is not possible to the specified destination.

If an order is cancelled, customers will be notified and refunded in full.

 

4. Pricing & Payments

All prices on the website include VAT where applicable.

Payments must be completed at checkout using one of the available payment methods.

ModTime is not responsible for:

  • bank processing delays,

  • additional charges from the customer’s bank or payment provider.

 

5. Shipping

All products are shipped from our workshop in Asia after hand assembly.

Delivery times vary depending on the destination country. Full details are provided in our Shipping Policy.

ModTime is not responsible for delays caused by:

  • customs clearance,

  • postal congestion,

  • incorrect addresses provided by the customer,

  • force majeure circumstances.

 

6. Customs & Import Duties

For orders to the European Union / Europe and the United States, all import duties and taxes are included (DDP) — the customer pays nothing extra on delivery.

For destinations outside the EU and the US, import duties or taxes may apply and, where applicable, are the responsibility of the customer.

 

7. Returns & Refunds

Our full return conditions are available in the Refund Policy.

Returns are accepted only in the following situations:

  • verified movement or mechanical issues,

  • assembly-related defects confirmed by our team.

Returns for general preference changes (e.g., color, style, size) are not accepted.

Customers must contact us before initiating a return.

 

8. Warranty

All ModTime watches include a standard warranty covering:

  • verified mechanical defects,

  • issues resulting from improper assembly.

The warranty does not cover:

  • water damage due to misuse,

  • damage from drops or impacts,

  • modifications performed by third parties,

  • signs of excessive wear.

 

9. Accuracy of Information

We strive to provide accurate, complete, and up-to-date information.

However, we cannot guarantee that all content (images, descriptions, technical specifications, FAQs) is error-free.

We reserve the right to update product information at any time without prior notice.

 

 

10. Prohibited Uses

You agree not to:

  • use the website for illegal activities,

  • attempt to interfere with website security,

  • misuse our intellectual property or branding,

  • provide false information during purchase.

Violation of these rules may result in order cancellation or account restriction.

 

11. Limitation of Liability

ModTime is not liable for:

  • delays in delivery outside our control,

  • damages caused by improper use of the product,

  • costs related to customs, import duties, or failed deliveries,

  • indirect or consequential damages.

Our total liability is limited to the purchase price of the product.

 

12. Governing Law

These Terms are governed by the laws of Poland and apply to all purchases made through our store.
